Placing an order on the website «mashacreate.shop» constitutes full acknowledgment and unconditional acceptance by the Buyer of this Public Offer Agreement, as well as the rules for ordering, purchasing, and shipping goods. If the Buyer disagrees with these terms, they must refrain from placing orders on this website.

1. General Provisions

1.1. This Agreement is a public offer (pursuant to Art. 633 of the Civil Code of Ukraine) between Sole Proprietor (FOP) Nataliia Leonidivna Lavreniuk (hereinafter referred to as the «Seller») and any individual or legal entity (hereinafter referred to as the «Buyer») placing an order via «mashacreate.shop». The Agreement defines the terms and conditions of remote sale of products presented on the website.

1.2. The terms of this Agreement are identical for all Buyers without exception.

1.3. In accordance with Art. 642 of the Civil Code of Ukraine, the moment of full and unconditional acceptance (acceptance) of this offer is the placement and electronic confirmation of an order by the Buyer on the website.

1.4. An «Order» refers to the Buyer's application submitted via the website or designated channels for the purchase and delivery of selected products.

1.5. The Buyer may revoke their acceptance prior to or at the moment of receiving order confirmation from the Seller.

1.6. By accepting the Offer, the Buyer confirms that:

  • They have fully read, understood, and agreed to the provisions of this Agreement.
  • They grant perpetual consent for the collection, processing, and transfer of their personal data to the Seller for order fulfillment, financial settlements, and marketing/advertising communications. The Buyer is notified of their rights under the Law of Ukraine «On Personal Data Protection». The Seller reserves the right to transfer personal data to third parties (logistics providers, payment systems) solely to fulfill this Agreement without additional notice to the Buyer.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of the confirmed products presented on «mashacreate.shop» to the Buyer, and the Buyer undertakes to accept and pay for the Goods according to these terms.

2.2. This Agreement governs: product selection and order placement by the Buyer; payment execution procedures; order processing, packaging, and delivery to the Buyer.

3. Order Placement Procedure

3.1. Orders are placed through the shopping cart on «mashacreate.shop» or via contact phone numbers/messengers specified on the site.

3.2. When placing an order, the Buyer must provide the following information: Full Name of Buyer or Designated Recipient; delivery address or postal/logistics branch details; contact phone number and email address; product name, SKU, quantity, and price. If the provided information is insufficient, the Seller may request clarification. Failure to provide necessary details exempts the Seller from liability for proper service quality and order fulfillment.

3.3. The Buyer is solely responsible for the accuracy of the provided information.

3.4. The Buyer may order any item available for sale on the website.

3.5. Quantity per item in an order is unlimited, subject to stock availability.

3.6. The contract is deemed concluded upon electronic confirmation on the website or receipt issuance upon telephone ordering.

3.7. If an item is out of stock, the Seller shall notify the Buyer via phone, email, or messenger.

3.8. The Seller may suggest a substitute for out-of-stock items upon mutual agreement. The Buyer reserves the right to decline substitution if the ordered item is unavailable.

4. Pricing and Payment Terms

4.1. Current product prices are specified on the website «mashacreate.shop» on the respective product cards.

4.2. The Seller reserves the right to change product prices on the website unilaterally.

4.3. If the price of an unfulfilled (unpaid) order changes, the Seller will inform the Buyer. The Buyer may confirm the order at the new price or cancel it.

4.4. Price changes for fully paid orders are not permitted.

4.5. Payment obligations are deemed fulfilled once funds are credited in full to the Seller.

4.6. Payment options include: online payment on the website, cash on delivery at the postal branch, bank transfer to a account/card, or cash payment (where applicable).

4.7. Unpaid orders may be canceled by the Seller at its discretion.

4.8. Shipping costs are borne by the Buyer (unless promotional terms state otherwise) via delivery services to the specified address. Items uncollected within the carrier's maximum storage period will be returned to the Seller.

5. Return and Exchange Policy

5.1. Items of proper quality: Pursuant to Cabinet of Ministers Resolution No. 172 dated March 19, 1994, perfumery, cosmetics, personal hygiene items, and tools (including manicure and pedicure tools) of proper quality are non-returnable and non-exchangeable.

5.2. Claims regarding individual intolerance or allergic reactions to ingredients are not accepted by the Seller. Patch testing is the Buyer’s responsibility. Discontinue use immediately if a reaction occurs.

5.3. Defective or Incorrect Items: Returns/exchanges are accepted under the condition that: The Buyer must inspect the completeness, packaging integrity, and condition of goods upon pickup in the presence of the delivery courier/postal worker; Any defects or discrepancies must be reported immediately, and the shipment rejected before signing delivery documents. Claims regarding appearance, quality, or completeness raised after signing delivery receipts will not be accepted or satisfied.

6. Rights and Obligations of the Parties

6.1. The Seller has the right to: demand compliance with this Agreement; suspend order fulfillment if the Buyer breaches contract terms.

6.2. The Buyer is obligated to: pay for and collect ordered goods in a timely manner.

6.3. The Buyer has the right to: place orders on the website and demand proper execution of the Agreement.

7. Liability and Force Majeure

7.1. Parties are liable for non-performance under Ukrainian law and this Agreement.

7.2. The Seller is not liable for: minor changes in packaging design by manufacturers; slight color variations resulting from screen/display settings; damage caused by improper product use by the Buyer; inaccurate information provided during order placement; shipping delays caused by delivery services beyond the Seller's control.

7.3. Parties are released from obligations in cases of Force Majeure. Disputes shall be resolved through negotiations.

8. Miscellaneous

8.1. The Seller may update terms unilaterally by publishing revised versions on «mashacreate.shop». Browsing the catalog and placing orders on the website is free of charge for the Buyer.

8.2. This Agreement enters into force upon order acceptance (Art. 11 Para. 6 of the Law of Ukraine «On Electronic Commerce») and remains valid until fully performed.
